I am a Computer professional
with a Master's degree. My employer is sponsoring me and an
application for labor certification has been filed. I have
heard that there is a process called RIR. Can I qualify in
the same?
RIR is
a process called Reduction in Recruitment. This process allows
an employer to request that the recruitment efforts he must
undertake are reduced, if the employer has attempted to recruit
US workers for the position offered before filing the application
for the labor certification.
The employer must file a written request for a reduction of
recruitment efforts and document his efforts to test the labor
market for the last six months. The employer must show that
he has made good faith, reasonable efforts to recruit US workers
and that these efforts have failed. The employer should provide
any information that will support the assertion that any further
recruitment would be unsuccessful. The employer must have
made the effort at recruitment at the prevailing wage and
working conditions of the particular employment opportunity
and through the normal channels of recruitment for that occupation.
Documentary evidence may include:
1) evidence that within the immediately preceding six
months, the employer has
made good faith efforts to recruit US workers
for the job opportunity, at least at
the prevailing wage and working conditions,
through sources normal to the
occupation AND
2) information that the employer believes would show that
any further recruitment
efforts will be unsuccessful
